1. About
ARTLittle is operated by 88 Degree Studio, a sole-proprietor / business operating in Malaysia. Contact: artlittle.com@gmail.com.
2. Accepting these Terms
By creating an account or using ARTLittle you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.
3. Eligibility
You must be at least 13 years old. If you are between 13 and 18 you confirm that your parent or legal guardian has consented.
4. Your account
- You are responsible for securing your account and password.
- Don’t share credentials with others.
- Tell us immediately if you suspect unauthorised access.
- You may delete your account any time by emailing artlittle.com@gmail.com.
5. Community rules
You must not:
- Harass, threaten, impersonate, defame, or abuse other users.
- Post illegal, infringing, hateful, sexually explicit, or obscene content.
- Spam, scam, or commit fraud.
- Exploit bugs, run bots, scrape, reverse-engineer, or disrupt the platform.
Violations may lead to warnings, content removal, suspension, or permanent termination at our discretion.
6. Your content — ownership
You retain copyright of everything you create on ARTLittle — graffiti paintings, voice messages, Time Vault messages, social posts, avatar designs, uploaded media.
7. Your content — licence to us
By posting content, you grant 88 Degree Studio a non-exclusive, royalty-free, worldwide licence to host, store, display, and archive your content within ARTLittle and to include screenshots of the platform (which may include your content) in our own marketing of ARTLittle itself.
For any other commercial use — merchandise, prints, NFTs, paid advertising campaigns featuring your specific work, or third-party licensing — we will contact you first, explain what we want to do, and ask your permission. Terms (payment, credit, scope) will be agreed case by case. You may decline.
You warrant that you own the content you upload or have the rights to upload it.
8. Shared content
Some features (e.g., the Graffiti Wall) create shared canvases with multiple contributors. Each contributor owns their own contribution. For commercial use of a collaborative piece we will seek permission from all identifiable contributors.
9. Moral rights
We respect your moral rights under Malaysian Copyright Act 1987 section 25: attribution and protection of the integrity of your work.
10. Content removal
We may remove or restrict content that violates these Terms or applicable law, with or without notice. We will tell you where reasonably possible.
11. Our intellectual property
ARTLittle’s name, logo, platform code, design, “ARTLiTTLE” branding, and related trademarks belong to 88 Degree Studio. You don’t acquire any rights to our IP by using the platform.
12. Purchases
Where ARTLittle involves purchases (art, services, memberships), those sales are governed by the terms on the relevant product page plus any separate Refund Policy.
13. Third-party content and services
ARTLittle hosts user-generated content (graffiti, voice messages, social posts, screenshots, videos, avatar designs) and integrates third-party services (WebRTC peers for voice/video calls, Google AdSense, payment processors, NFT/wallet providers, WebSocket relay servers). We do not pre-screen or moderate user content in real time, do not endorse or verify any user content or third-party service, and are not responsible for the acts, omissions, content, or service quality of users or third parties. Use your own judgement.
14. Disclaimers — provided “as is”
ARTLittle is provided “as is” and “as available” with all faults. To the maximum extent permitted by law, 88 Degree Studio expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, security, uninterrupted operation, error-free performance, or compatibility with any device, browser, headset, or operating system.
We do not warrant that: (a) the service will meet your requirements; (b) the service will be uninterrupted, timely, secure, or error-free; (c) any information obtained from ARTLittle is accurate or reliable; (d) defects will be corrected. You use ARTLittle at your own risk.
15. Assumption of risk
You acknowledge and accept that:
- VR / AR / 3D features may cause motion sickness, eye strain, fatigue, or seizures (including in people with no prior history). Take regular breaks. Stop immediately if you feel unwell. Do not use VR if you have a medical condition that may be triggered. Use VR/AR only in a safe physical space free of obstacles.
- Voice and video calls are peer-to-peer (WebRTC). We do not record them, but other participants may record using external tools. Do not say or show anything you would not want recorded.
- Spatial audio and 3D sound in headphones may be loud — adjust your volume.
- Other users on ARTLittle may post content that is offensive, inaccurate, misleading, illegal, or harmful. We are not responsible for their conduct or content.
- Crypto / wallet / NFT features are highly volatile and risky. We do not provide investment, financial, or legal advice. Connecting a wallet to ARTLittle is at your own risk.
- User-uploaded media may contain malware, harmful links, or be subject to copyright claims by third parties. Download or interact at your own risk.
16. No professional advice
Nothing on ARTLittle (including content posted by us, by other users, or shown via third-party services) constitutes legal, financial, medical, investment, tax, or any other professional advice. Consult a qualified professional for advice specific to your situation.
17. Limitation of liability
To the maximum extent permitted by Malaysian law:
- 88 Degree Studio’s total aggregate liability arising out of or relating to ARTLittle, the service, your use of the service, these Terms, or any content — whether in contract, tort (including negligence), or otherwise — is capped at the greater of (a) the amounts you have paid us in the 12 months immediately before the event giving rise to the claim, or (b) MYR 100.
- We are not liable for any indirect, incidental, consequential, special, exemplary, punitive, or reliance damages, including without limitation lost profits, lost data, lost goodwill, lost opportunity, business interruption, computer failure, personal injury, emotional distress, or any damages caused by other users.
- We are not liable for damages caused by events outside our reasonable control (see Force Majeure below), by your failure to follow these Terms, by your loss of credentials, or by your interactions with other users.
- This limitation applies even if we have been advised of the possibility of such damages, and even if a remedy fails its essential purpose.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential or incidental damages, so some of the above may not apply to you. In such jurisdictions, our liability is limited to the smallest extent permitted by law.
18. Indemnification
You agree to defend, indemnify, and hold harmless 88 Degree Studio, its operators, employees, contractors, affiliates, suppliers, and licensors from and against any and all claims, demands, lawsuits, losses, damages, fines, penalties, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your access to or use of ARTLittle;
- Your content (including any allegation that your content infringes IP, privacy, defames, harasses, or violates any law);
- Your violation of these Terms or any applicable law;
- Your interactions or disputes with any other user;
- Your acts or omissions in voice/video calls, voicemails, DMs, graffiti, posts, or any other communication on the platform.
We may, at our option, assume the exclusive defence of any matter for which you are required to indemnify us, in which case you will cooperate with us at your expense.
19. User-to-user disputes
ARTLittle is a platform — we are not a party to disputes between users. If you have a dispute with another user, you agree to resolve it directly with that user. You release 88 Degree Studio (and its operators, employees, contractors, affiliates) from any claims, demands, and damages of every kind and nature arising out of or in any way connected with such disputes.
20. Force majeure
We are not liable for any delay, interruption, or failure of the service caused by events outside our reasonable control, including without limitation acts of God, natural disasters, war, terrorism, riots, government action, pandemics, internet outages, hosting-provider failures, denial-of-service attacks, hardware failures, software bugs in third-party dependencies, or telecommunications failures.
21. Severability and entire agreement
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full force and effect. These Terms (together with the Privacy Policy and any Refund Policy or product-page terms) constitute the entire agreement between you and 88 Degree Studio regarding ARTLittle and supersede all prior agreements on the subject.
22. No waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. Any waiver must be in writing.
23. Termination
We may suspend or terminate your account, with or without notice, at any time and for any reason — including violations of these Terms, suspected fraud, or to comply with law. You may delete your account at any time. Sections 6, 7, 14–22, and 24 survive termination.
24. Governing law and jurisdiction
These Terms are governed by the laws of Malaysia, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the service is subject to the exclusive jurisdiction of the courts of Malaysia. You agree not to bring any claim except in those courts.
25. Changes
We may update these Terms at any time. Material changes will require you to re-agree on your next sign-in. Continued use after a change constitutes acceptance. The effective date at the top identifies the current version.
